Self Conformity Declaration for KC EMC is effective as of July 24

The KC EMC regulation has been updated and the Self Conformity Declaration system was implemented on July 24th. (RRA link)

What is Self Conformity Declaration?

The scope of Self Conformity Declaration is that “Equipment prescribed by presidential decree, such as equipment that is unlikely to cause harm to the radio wave environment and broadcasting and communication networks.” It means the equipment specified and notified by the Minister of Science and ICT as broadcasting and communication equipment falling under any of the following subparagraphs.

1. Broadcasting and communication equipment used for measurement and inspection, etc.
2. Broadcasting and communication equipment used for industrial and scientific purposes
3. Broadcasting and communication equipment that is not likely to cause harm to the radio environment or broadcasting and communication networks, etc.
4. Other broadcasting and communication equipment that does not require testing by a designated testing organization based on the characteristics or use of the equipment.

The conformity registration classification method, which was previously categorized as “designated testing laboratory” and “self-testing”, has been divided into conformity registration and self-conformity declaration.

What are the differences before & after?

Designated representative’s role strengthened

The role of domestic representatives has been strengthened with the creation of a separate legal provision for them.

Article 58.13 (Designation of Domestic representative)
① If a company without an address or business office in Korea wishes to obtain a conformity assessment, it shall designate a representative with an address or business office in Korea as its representative in writing.
② The representative designated as a representative pursuant to paragraph (1) (hereinafter referred to as the “domestic representative”) shall be responsible for the following matters
1. application for conformity assessment, application for change of conformity assessment, and disclosure of self-conformity confirmation
2. submission of relevant data or equipment pursuant to Article 71(2)(2)
③ If the domestic representative violates this Act in relation to each of the items in paragraph 2, the company who received the conformity assessment shall be deemed to have committed the act.

Domestic representative tasks

The domestic representative must submit a written statement of representation and represents the following items

1. Requesting a Conformity Assessment
2. Disclosure of Self-Certification of Conformity
3. Reporting changes
4. Revocation of a Conformity Assessment
5. Reissuance of the certificate
6. Submission of the relevant data pursuant to Article 71(2)(2) of the Act or submission of the relevant equipment
